The agreement

Merc Wrath (the “Game”) is published by Lunana Global Inc. (“we”, “us”). By installing or playing the Game, or using any related service we operate (together, the “Service”), you accept these terms. If you do not accept them, do not play. The Privacy Policy and the App Licence are part of this agreement.

Who may play

You must be at least 13 years old (or the higher minimum age of digital consent in your country) to play. If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf. You may not play if we have previously banned your account.

Your licence to play

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own entertainment and no other purpose. You may not copy, modify, distribute, sell, rent, reverse-engineer, or create derivative works from the Game except where law expressly permits it despite this clause.

Your account

Your progress is tied to an account. You are responsible for keeping access to your account and device secure, and for everything that happens under your account. Accounts may not be sold, traded, shared, or transferred. You have no ownership or property interest in your account.

Virtual items and currencies

The Game contains virtual currencies and items (for example coins, sigils, gems, gear, and similar). These exist only inside the Game: they have no real-world value, cannot be exchanged for money or anything of value outside the Game, and are licensed to you, not sold. Except where required by law or by the platform you purchased through, all purchases are final and non-refundable. We may change, rebalance, or retire virtual items and currencies as part of operating the Game.

Fair play and conduct

You agree not to:

• cheat, including exploits, bots, automation, modified clients, tampering with the Game’s memory or network traffic, or abusing bugs you should reasonably know are bugs;
• harass, threaten, or abuse other players, or use an offensive player name;
• buy, sell, or advertise accounts, virtual items, or in-game services for real-world value;
• disrupt the Service, probe it for vulnerabilities, or access it by any means other than the Game client we ship.

Breaking these rules can result in warnings, rollback of ill-gotten progress, or permanent bans, at our discretion.

Playing on other players' keeps

Merc Wrath is an asynchronous multiplayer game. When you post a contract, other players fight waves on a copy of your keep; when you take a contract, you fight on a copy of theirs. You understand that your player name, keep layout, defence results, replays, and contractor rating are visible to other players as part of normal play, as described in the Privacy Policy.

Updates, changes, and availability

The Game is a live service. We may patch, rebalance, add, or remove content at any time, and may require updates before you can keep playing. We may suspend or discontinue the Service, in whole or in part, at any time. Where reasonably practicable we will give notice before permanently shutting the Service down, but we are not obliged to keep any game available indefinitely.

Ownership

The Game and the Service, including all code, art, audio, characters, names, and other content, are owned by Lunana Global Inc. or its licensors and are protected by intellectual-property law. Except for the limited licence in these terms, no rights are granted to you.

App stores

You obtain the Game through a platform such as the Apple App Store or Google Play. Those platforms’ own terms also apply to your download and purchases, and platform operators are not responsible for the Game or these terms.

Termination

You may stop playing and delete your account at any time. We may suspend or terminate your account if you materially breach these terms. On termination your licence ends and you lose access to your account and any virtual items in it; no refund is owed for unused virtual items except where the law requires one.

Disclaimer of warranties

Limitation of liability

Indemnity

You will indemnify Lunana Global Inc. against claims and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the Service, except to the extent we caused the loss.

Changes to these terms

We may revise these terms as the Game evolves. Material changes will be announced in the Game or on this site, with the effective date above updated. Continuing to play after a change takes effect means you accept the revised terms; if you do not accept them, stop playing.

Governing law and disputes

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts located in Vancouver, British Columbia have exclusive jurisdiction over disputes arising from these terms or the Service, and each party attorns to that jurisdiction. Where local consumer law gives you mandatory rights or a mandatory forum, this clause does not displace them.

General

If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign this agreement; we may assign it to an affiliate or in connection with a merger or sale. These terms, together with the Privacy Policy and App Licence, are the entire agreement between you and us about the Service.
